The Bombay High Court is expected to pronounce its order on a petition filed by Satish Salian, the father of Disha Salian, concerning the investigation into her death in June 2020.

The petition raises allegations of shortcomings in the investigation conducted by the Mumbai Police and seeks further action in connection with the case. The matter has drawn renewed legal attention following hearings in which questions were raised about the nature of the police investigation and the family’s allegations.

The outcome of the court proceedings will depend on the High Court’s final order.

Petition Raises Questions Over Police Investigation

Satish Salian’s petition challenges aspects of the police handling of the case and raises allegations regarding the investigation.

According to statements previously made by advocate Nilesh Ojha, who represents Satish Salian, the family questioned why an FIR was not registered despite allegations contained in their complaint.

Mumbai Police had registered an Accidental Death Report (ADR) in connection with Disha Salian’s death.

It is important to note that allegations made by a petitioner or counsel in court proceedings are claims that remain subject to judicial examination. They should not be treated as established facts unless supported by findings from a competent court or investigating authority.

Advocate Refers to Court’s Questions During Hearing

Following an earlier hearing, advocate Nilesh Ojha told ANI that the court had questioned the police regarding the absence of an FIR in response to the allegations raised by Disha Salian’s family.

Ojha said the issue before the court was not limited to the findings of the investigation conducted under the ADR.

According to the advocate’s account, the court sought to understand why the family’s complaint and allegations had not resulted in the registration of an FIR.

The Mumbai Police and other respondents have the opportunity to present their position before the court, and the matter remains subject to the High Court’s judicial determination.

Serious Allegations Remain Matters Before the Court

The petition reportedly contains serious allegations relating to the circumstances surrounding Disha Salian’s death.

Counsel for the petitioner has made claims about the evidence and the conclusions reached during the earlier investigation. These statements represent the petitioner’s legal position and should not be interpreted as judicial findings.

No allegation of a criminal offence should be presented as proven unless it has been established through a lawful investigation or a court proceeding.

The High Court’s order will therefore be significant in determining what further legal or investigative steps, if any, are warranted.

Concerns Raised Over ADR and Access to Documents

During the proceedings, concerns were also raised regarding the registration of an ADR rather than an FIR, according to the material presented in the case.

The court was also informed of issues relating to access to documents connected with the investigation, including the post-mortem report and the ADR.

According to the account provided in the petition-related proceedings, the family had raised concerns about receiving copies of these documents.

The court reportedly asked for a structured presentation of the sequence of events and the circumstances that the petitioner contends disclose a cognisable offence. The respondents, including the State and Mumbai Police, would then have an opportunity to respond.

High Court Proceedings Continue to Draw Attention

The case has remained the subject of significant public attention because of the serious nature of the allegations and the legal questions raised about the investigation.

However, ongoing judicial proceedings require careful reporting. Claims made by petitioners, lawyers, police officials and other parties must be clearly attributed, particularly where allegations have not been judicially established.

The High Court’s eventual order will determine the next legal course in the matter.

Order Awaited

The petition filed by Satish Salian places the investigation into Disha Salian’s death once again before the Bombay High Court.

The court’s decision will be important in determining whether the petitioner’s requests for further action are accepted and whether any additional directions are issued to investigating authorities or other respondents.

Until the order is formally pronounced and its text is available, the final outcome should not be assumed.

Hunterfly.in will update this report with the High Court’s decision and the operative directions of the order once they are officially available.
